ASSIGNMENT TO HOLDER-CLAIM AGAINST BANK
PRESENTMENT DELAY
[Name of assignor], of [address of assignor], [city of assignor], [state of assignor], in this document referred to as assignor, is the maker of an instrument, dated [date of instrument], by which assignor promised to pay at [Name of bank], located at [address of bank], [city of bank], [state of bank], in this document referred to as bank, $[Amount of assignment] Dollars on [date], to the order of [Name of payee], of [address of payee], [city of payee], [state of payee]. The present holder of the instrument is [Name of holder of the instrument], of [address of holder], [city of holder], [state of holder], in this document referred to as assignee.
On [date of deposit], assignor deposited $[Amount of deposit] Dollars with bank to meet the payment of this instrument. Assignee did not present the instrument for payment on the due date and delayed, without cause, in making presentment until [date of presentment]. During the time between the due date of this instrument and the date when the instrument was actually presented by assignee for payment, bank became insolvent and no payment can be presently made to assignee from the amount deposited with bank.
Therefore, assignor hereby assigns to assignee [his or her] rights against bank with respect to the funds deposited as described above to discharge the obligation of assignor as the maker of the instrument described above.
